Davis arrested Sunday

Rising sophomore Enrique Davis was arrested at the Exchange early Sunday morning while at a party at Jerrell Powe’s apartment. Powe, a junior, received a citation for a noise violation.
According to the police report, officers were dispatched to the Exchange following a noise complaint where a Hummer was driving around the parking lot sounding its horn. Upon arrival, loud music was heard coming from the second floor of Powe’s apartment building.
The officer approached Powe and took his identification. On the way back to his patrol vehicle, a young black male, later identified as Enrique Davis, made a comment that the officer could not understand, the report said.
The officer requested Davis hand over his identification, but Davis looked at the officer with a “shunning face,” according to the report.
The report said the officer then requested Davis’ identification several more times and Davis started to walk towards the stairwell and gave the officer a “crazy face” when confronted about walking away. The officer grabbed Davis’ left elbow to stop him, but Davis pulled away from the officer, who then put him up against the stairwell and placed him in custody for disorderly conduct and failure to comply, the report said.
Once Officer Zachary White had placed Davis into the patrol car, he returned to address the noise violation concerning Powe. According to the report, while White wrote the citation for a noise violation, Powe said, “Zachary White, I got you. I’ll remember that.”
White asked if Powe would read the bottom of the citation and sign it to ensure he would show up in court, but Powe stated he could not read and would not sign, the report said.
The officer informed Powe that he did not need to sign and he would issue the citation regardless. Powe finally read the citation information and signed and was released afterwards.
Davis rushed for 244 yards last season and three touchdowns as a true freshman. Davis tallied 17 yards on five carries in the spring game. Davis is competing with Devin Thomas and Cordera Eason for the backup role to rising sophomore Brandon Bolden in the backfield.
Powe made his long awaited debut last season and finished the season with eight tackles, 3.5 for loss and one interception on the year.









If this story is accurate, I’m disappointed in Davis and Powe. No one is above the law and they should not act like they should get special treatment.
As for the Hummer that was driving around in circles and honking the horn, was that Coach O?
Having defended 100s of these cases Thomas is absolutely not guilty and that Officer was absolutely wrong. He needs to go read the law!
You’re disappointed in Powe and Davis?
You really should look into moving to China. If you want to live in a police state where you can be arrested for giving a cop a “shunning face” and refusing to produce your “papers” upon request of a state police agent, then move to China. If you think the law allows the police to demand people identify themselves at request, go back to your 8th grade civics class. If you think this was anything other than the local cops arresting someone for not respecting their authority, read the article again, slowly.
I’m disappointed that any American would read this and think anything other than, “The cop who arrested Davis should be sued for violating his civil rights”. Our Founding Fathers didn’t set up our Constitution to allow this kind of crap.

I blame the schools:
Spoken like a true college student who does not live in the real world. Why do you have a chip on your shoulder and who cares about China!?! An officer of the law asked him for his ID after Davis made some sort of comment. There is only one person to blame for his arrest and that is Davis himself. If you smart of to a cop, expect a response. When the cop asks you for ID and you start to walk away, expect a response. When he tries to grab you to stop you from leaving the scene and you jerk away, expect a much harsher response. If Davis had kept his mouth shut we would not be having this conversation today. He has only himself to blame. No one else mouthed of to the officer and ALAS, no one else got arrested.
Also, wait til you have children and they mouth off to you or don’t listen to what you say. I wonder how long you will let that behavior slide.
As for Powe, he was being a smart@$$ too. Telling the cop he couldn’t read and wouldn’t sign the ticket!?! How juvenille is that? The place to argue with an officer is in court, not late at night after drinking, it will get you in more trouble and written about in the paper.
I love watching those two guys on the field, but they need to be more respectful to their neighbors, the police, and the University of Mississippi, which they represent at ALL TIMES.

Smarting off to authority figures is exactly what this country was founded upon. If you don’t think the Declaration of Independence was nothing more than a fancily written way of flipping off the King of England then you are mistaken. Heck, the very purpose of our nation’s constitution is to establish an authority which is subject to scrutiny and question.
These cops could have just told the guys to go home and keep the noise down but, being as how they’re high-profile football stars, they went on a power trip and took it too far.
Of course we don’t know all the inflections and tone of the comment shared here, but it seems the officer responded to a call about a car horn, heard more noise and went to address it. Powe, by the story’s account, seemed compliant at first.
But it seemed Davis was repeatedly asking for trouble. I’m not sure what a “shunning” face is, but coupled w/ a crazy face and comments toward a policeman after midnight is a quick way to get in trouble. And if they try to talk w/ you and keep you from walking way, jerking away like that isn’t smart. And neither are the comments that Powe made after Davis was taken into custody.
I hope the guys learn a lesson and don’t mouth off to cops anymore. It’s got nothing to do with China. Was the cop overstepping his bounds? Didn’t appear to be by the above story.

I think you are missing the big picture.
Davis did nothing wrong. Shunning/Crazy faces are not illegal. In fact, a cop cannot ask you for your ID in this case so Davis should have never had to give the crazy face and this entire deal would not have happened.
See what is not in the story - He did not get arrested for..insert the blank. He wasn’t arrest for public intox, which leads me to believe that he wasn’t drunk. He didn’t get resisting arrest which means that he complied once the officer arrested him.
What if someone came to where you are right now and asked you for papers? Would you do it. If so, you are a subject of this police state and not a free citizen.
Like my Pappy said, “Nothing good happens after midnight.”
A police officer must have reasonable suspicion to detain someone. Mere refusal to show ID is not reasonable suspicion. In the United States, it has never been legal for police to detain someone for refusing to speak to police who have no reasonable suspicion to question them.
This isn’t a case where someone was pulled over for speeding - in that case they have broken the law. Roadblocks and ID checks are different because one needs a driver’s license to drive and police have valid interest in providing highway safety.
But, standing around minding my own business, I can stick my tongue out to a police officer if he asks me for ID and he can’t do anything about it.
I don’t know why this officer had a problem with a young African American gentleman exercising his rights.
I think the bigger question here is: How in the world is Powe playing football and he admittantly can’t even read?

I don’t want a Police State, but c’mon. Officers are here to serve and protect. A call related to noise can and sometimes does lead to a more serious situation. These men and women often only have an extremely rough idea of what they are walking upon. If these young men had identified themselves and not been smartasses then this whole situation would have been avoided. It’s just STUPID and the STUPIDITY lies with the source of the NOISE to start with.
Uh, the noise complaint was about a Hummer blowing its horn. The music was not complained about. Hearing music coming from a college student’s apartment does not create a situation where you “don’t know what you’re going into.” The Exchange is far from a crack den.
This guy thought a young black guy “may” have sassed him as he was leaving. Tensions weren’t “escalated.” Davis could have been making plans to go to church the next morning. It seems pretty clear the cop just wanted to flex his muscles, but he wasn’t ready for Davis to exercise his rights.
Note that the officer was leaving and then arrested Davis - and then went back to give a noise citation. This guy just got his feeling hurt and wanted to get back at everybody he could. I think we should all be happy there wasn’t an alcohol arrest - seems like our players were behaving pretty well, if you ask me.
Also, since Powe read the officer’s name on the paper, I think its safe to assume he was being sarcastic when he said he can’t read. Apparently, not only can Powe read - he has a sarcastic sense of humor.
Well, Powe’s mother said he can’t read, now Powe himself says he can’t read, yet the Reb “spin” is that yes, he can read. Which is it?
My guess is that he’s coloring inside the lines now, and that qualifies as “reading” at UM.
Look, Jon, I am a big believer in being respectful to the police and don’t think I would have been in this situation. But you seem to be missing a big point here. The officer was responding to a complaint about a vehicle honking its horn. NO ONE had complained about the music in Powe’s apartment. NO police department that I know of is going to “investigate” what an officer considers loud music unless there has been a complaint about it. The officer was out of bounds in his actions. He created the problem when he did not find the offending Hummer and proceded to go after what he perceived as another source of noise. He should called “no joy” in and asked for direction before charging off on another tangent at this apartment complex.
I wish Davis and Powe had been more respectful, but the police officer was in the wrong here, based on the police reports themselves. And you do have to wonder if the fact that they were African Americans had anything to do with it.
It is not the right thing to do, and nobody said he did, but it is not against the law to make comments in front of the police that they don’t like. The police trying to criminalize something said in front of them that is free speech is just plain wrong. And a citizen not breaking the law cannot be stopped “just because”.
If I was the chief of police, I would suspend the officer and get him some community sensitivity training. It sounds to me like the office has issues and needs to be trained or let go.
This really still is a free country.
I have had experience with the Oxford police. When my daughter was in school and living in an off-campus house they had an end of semester party and the noise level got too high. Policemen arrived and were handing out tickets to everyone there. One of her roommates had not been at the party, and arrived. Walking up to my daughter who was talking to one of the policemen, the roommate asked what was going on. The cop instantly wrote her a ticket even though she had not been at the party. In handling the situation I explained the circumstances of her ticket to the prosecuting atty who examined the tkt and said he would dismiss it, not because of the circumstances, but because the cop had made erroneous entries on the ticket. These Law Enforcement attitudes and actions breed disrespect for the law, not enhance it. Our Policemen, everywhere, need comprehensive training in common sense and PR.
I am very disappointed in Coach Nutt. He claims that Jerrell should “keep his mouth shut.” I call BS on that. Coach has no right trying to impose on Jerrell’s 1st Amendment right. What have we become when we have no freedom of speech. These cops are just mad because they are not a big deal like the players they were racially profiling. I hope someone loses their job over this.
This is just idiotic. Put aside all this crap about the “Policeman Needing to be Sued” and that “Davis did nothing wrong”. He is still a freaking idiot. There is absolutely no reason for him to even open his mouth. Regardless of whether he was breaking the law. Just dumb.
And Yes, i agree with “Chris”… Powe’s mother did say “he’s a good boy he just can’t read!”… Ridiculous. How is this guy in college?
Ole Miss…. The “Harvurd” of the South
Two things. First, it’s not against the law in this country to “open your mouth.” The funny thing is, Davis was arrested for remaining silent. I just sat in a room with three law students studying Criminal Procedure - each one of them working for a different Prosecutor’s Office this summer so they are not “criminal-friendly” and none went to Ole Miss undergrand and all are from out of state - and each one said there’s no legal standing for the officer to have arrested Davis.
Second, the NCAA has never monitored the admission of an athlete into college more closely than Powe. He has taken tests and been watched by numerous neutral observers and all agree he made it into school on his own accord. I know how difficult it is for some people to read an entire arrest report, but Powe read the officer’s name on the report and said it aloud. Even “Every Day Should Be Saturday” realized he was being sarcastic. He sounds like a potential English major to me.
Brown v. Texas 1979:
An officer CAN NOT stop someone and ask for ID or their name when they don’t have reason to believe they committed a crime. Someone saying something the officer couldn’t comprehend is NOT a crime or any reason to suspect a crime had been committed. The detainment of Davis was illegal.
I didn’t contend that the young men committed any crime. I only asserted that police officers are often charged with the duty of upholding the law in situations that they must first figure out themselves (i.e. stumbling into circumstances that they only have a rough idea about to start with). It is not a “stretch” that officers were called out concerning a loud Hummer and instead heard loud noise from an apartment leading to their inquiry. Again, I made no mention that anyone committed a crime. I only assert that Powe and Davis apparently acted STUPID from start to finish. The young men should have been respectful and identified themselves. The whole situation would have been avoided had they done so.

This is total BS. Just like most cops I’m sure this guy came to the scene with a chip on his shoulder. Just because you come to a parking lot where noise was reported does not mean you get to arrest everyone there. The majority of cops are buttheads who take their authority to a whole new level and for some reason think that badge puts them above the law. This happens all the time. It wastes tons of man hours and all because some cop can’t stand being talked to or looked at by some ‘punk’ kid. F em! The guys should be suspended w/o pay but we know that won’t happen.

I have to ask because it’s written clearly there for the world to see that Jerrell Powe can and did read. The NCAA and The University of Mississippi each put Powe through the ringer before allowing him to participate in football. Jerrell passed. The only thing you’re passing is as a jerk-off.

Enrique Davis had no right to make a comment while leaving an apartment complex? Uh huh. Right. How did the cop know at the time that Davis wasn’t on the phone, using a bluetooth, talking to himself or saying aloud “Where did I park my car?” Short answer for anyone with a fraction of a brain; the cop didn’t have a clue therefore no cause, just as he didn’t know the law when demanding ED’s ID for being at an APARTMENT COMPLEX (you know, one of those places where many people live?). Enrique Davis had every right in the world to be at the location, he had every right in the world to deny providing ID and he most certainly had every right to rip his arm away from a cop that grabbed him for no reason other than not complying with a power trip.

And why is Powe in college? He EARNED his way in and through hard work to date, has earned the right to stay. What are you? State fan? Bama or Auburn? LSU….? Get over yourself. Powe earned the right to be at Ole Miss. Only thing you’ve earned is that name you’ve given yourself and a swift kick to the balls.
Someone driving around in a parking lot honking the horn over and over again gets the cops called on them - another person - who should have kept his mouth shut and stayed out of it, comes over and interferes with the officer deserves whatever he gets, especially when he refuses to identify himself and obey the officer/law. I’m sure he had no problem ‘mouthing off’ so he shouldn’t had any problem stating his name, etc.
As far as the driver claiming he couldn’t read - well - supposed ‘football star’ - did your mommie read your contract with the university to you? Apparently you could read after all, so you’re also a liar as well as not illiterate as you claim. You bring shame on your fellow team mates as well as your school.
You people out there claiming police state and all of the other liberal crap - better be thankful there’s people out there like that officer willing to put up with the criticism and abuse that you throw out there up until the time you need help from the police. Then you’re on the phone like all the other victims yelling for ‘help’ - too bad you can’t be put on a list to ignore you for those time you need help.
These people were breaking the law - regardless of their ’stardom’ and deserve what punishment is meted out to them. They should not get any different treatment from the law than anyone else.

BBishere…when exactly did mummbling under your breath become against the law? It has nothing to do with their ’stardom’ and it was just wrong. Davis didn’t break any laws. The officer came for a noise complaint. Obviously it wasn’t Davis…he coudln’t even hear him speak when he was right next to him. The cop just didn’t like the fact that someone wasn’t bending over backwards for his demands…its a stupid arrest and officer White is obviously an ass.

Did you read the article? Can you read? Powe wasn’t drivin the hummer, he has a white tahoe. The police did not find the driver of the hummer therefore Enrique did not approach the officers questioning anyone in the hummer because they never found the car nor was Powe driving.
Powe (who lives above me) was having a party and the officers came to his house after not finding the hummer and with no complaint ever being made against him. The officers came to them not the other way around. I do not doubt that a smart ass comment was made but they quite obviously and commonly do overstep their boundaries here in Oxford. Doesn’t matter what you are doing in Oxford the police assume first that you are guilty of something and they are morally bound to do whatever they can to prove that you broke the law. (I have never been arrested but accused of many things by oxford police.)
its so funny how people get on here and talk like they know these two personally… most people don’t and never will and even if they are exposed to a LITTLE BIT of their lives, you will never truly know them. no offense everybody sounds like they’re on a personal level and i really doubt that thats the case. one can find humor in the situation though. they “i can’t read” thing is very witty.
The two have attitudes. They should have turned the music down and shut up. Davis making childish faces at the police officer and drew attention to himself by acting out. Davis is nothing more than a clown. He should have went to auburn instead of embarrassing Ole Miss. He is trouble. This is only the start for his sorry butt. Just wait he isn’t finished. Why should it matter that Davis is a “football star?” I mean come on. If the average Joe were to do the very exact thing, he would be arrested, it would not be in the papers, nor would half of Oxford/University be in an uproar. But since this is a “football star” that we are talking about why should it be any different? Football players, along with any other member of a college sports team, go to school for free, have a housing stipend, and get spending money every month. So because they get to do all of this for free, they think that they should be above the law? WRONG! They are no better than the rest of us. Most of us work our tails off daily to do well in school, and be able to afford to stay in school. If we get stupid and do something such as Davis we pay the consequences.
Besides the fact that he was arrested, isn’t he a sophomore? Obviously there was a party, with more than likely alcohol, and by the way he was acting he was more than likely drinking. So for a normal sophomore this would put him at an age of 19 or 20. So whoever was hosting the party was also perfoming illegal actions by allowing for a minor to partake in the drinking. He is lucky that he did not get in more trouble than what he did.
Houston Nutt should learn that just because he is the coach of the Ole Miss Rebel Football Team, that his members are just like every other college student and must pay the same consequences. Nutt should also be punishing his football players and not allowing for them to get away with these types of actions. There should be consequences for anyone who breaks the law, whether you are the President, a “football star”, or the average Joe.
As long as davis was not driving a car, did not threaten the officer, and was not observed doing anything illegal, he had every right to refuse to identify himself to the officer.
I wish all these dumb@$$ cops in Oxford would read the damn constitution, both of the State of Mississippi and of the United States.
Good for Davis for doing what he could to preserve his rights. Maybe with all the lawsuits Oxford Po Po is getting now adays they will eventually go out of business.

Regardless of what happened at the scene, the tone of this article is inappropriate. It reads more like a gossip column than it a true news piece. The arrest of an Ole Miss football player is in fact news, but hearsay does not belong when reporting it.
Oxford police officers are slightly above mall security. They over react to any situation, especially if it involves a young college student,who is already one step ahead of them in life gaining an education. I believe jealously is what fuels their fire.
This is typical oxford police bs. So typical. They need to leave the students alone. Luckily the Hummer had already left or im sure that the cop would have tried to jump onto it and probably got dragged to death.
My favorite part is how Powe reads the cops name tag….then says he can’t read. Priceless!
First of all, the cop wasn’t messing with him first. He started it by mumbling something to a cop, which could have been a threat who knows? he could have just stayed out of it and the cop probably wouldn’t have given him a second look. Davis brought this on himself, he didn’t have to say anything to the cop. He was trying to show his ass because he probably thought he could get away with whatever because he is an athelete. As for Powe, it sucks to get a citation but I think you deserve one have loud music blasting from an APARTMENT at midnight. I’m sure some people were trying to sleep. Go to the club and be as loud as you want or stay home and be respectful of your neighbors. Think about it, if it had been another student that mumbled something at Davis he would have probably started a fight with him or something so how can you expect to be an a-hole and the same consequences don’t apply to you. He’s lucky the cop didn’t do anything else to him and maybe now he will learn to mind his own business. Can’t believe you people are defending this guy, it was ALL his fault.
